A federal judge’s ruling blocking dangerous abortion drugs mentioned important facts about how an abortion kills a human being with a “head, hands, and legs, … defined fingers and toes.”
On Friday, U.S District Judge Matthew Kacsmaryk agreed with Alliance for Hippocratic Medicine doctors that the Food and Drug Administration violated federal laws and ignored safety risks when it approved and later expanded use of the abortion drug mifepristone in 2000 and 2021.
His decision temporarily blocks the FDA’s approval of mifepristone, which is used to kill unborn babies up to about 10 weeks of pregnancy. About half of all abortions in the U.S. are done with the drug, according to the Guttmacher Institute.
Kacsmaryk’s ruling goes into effect later this week, but the Biden administration already is appealing.
In an analysis Monday, The Federalist senior legal correspondent Margot Cleveland said the judge’s opinion is a powerful, fact-based argument against the abortion drug.

“… while the left is already attacking Kacsmaryk’s 67-page straight-talking opinion in Alliance for Hippocratic Medicine v. FDA by framing it as filled with anti-abortion rhetoric, the Trump appointee stuck to the facts — something Americans desperately need to hear after decades of euphemistic discussions about abortion,” Cleveland said.
Importantly, the judge recognized that “humans” in the womb are at the heart of the controversy. Instead of referring to an unborn baby as a “fetus” or “embryo” as abortion activists often do, Kacsmaryk said “unborn human” is more accurate.
“The word ‘fetus,’ refers to a specific gestational stage of development, as opposed to the zygote, blastocyst, or embryo stages,” the judge wrote. He said “fetus” is not accurate because the abortion drug is used at several different “gestational stages.”
Kacsmaryk recognized the pain that abortions cause to both mothers and unborn babies by quoting studies and personal testimonies of abortion patients.
“The mother seeing the aborted human ‘appears to be a difficult aspect of the medical termination process which can be distressing, bring home the reality of the event and may influence later emotional adaptation,’” he wrote. “For example, one woman was surprised and saddened to see that her aborted baby ‘had a head, hands, and legs’ with ‘[d]efined fingers and toes.’”
Recently, American OB-GYNs have reported an alarming rise in women calling in traumatized after they took abortion pills and then delivered their aborted baby’s body at home. Even the pro-abortion website Aid Access, which sells abortion pills across the world, admits women may see their aborted baby’s body and it can be “distressing.”
Kacsmaryk pointed to studies showing other psychological risks, too, including one that found 38 percent of women reported problems “with anxiety, depression, drug abuse, and suicidal thoughts” after taking the abortion pill.
Pregnant mothers suffer physical risks as well, including “bleeding” that, “unlike surgical abortion, can last up to several weeks,” the judge’s ruling continued.
Now that the Biden administration has begun allowing abortion pills to be sold through the mail “without physician oversight,” women are at higher risk of “undetected ectopic pregnancies, failure of rH factor incompatibility detection, and misdiagnosis of gestational age — all leading to severe or even fatal consequences,” Kacsmaryk continued.
His ruling also noted the failings of the federal government and abortion providers to track complications. “… over sixty percent of women and girls’ emergency room visits after chemical abortions are miscoded as ‘miscarriages’ rather than adverse effects to mifepristone,” he wrote.
Also mentioned in the ruling, the Obama administration made a series of changes to the abortion drug, allowing it to be prescribed up to 10 weeks instead of seven, and requiring only one visit to the doctor’s office instead of three. At the same time, the administration stopped requiring the reporting of non-fatal complications due to abortion drugs.
As a result, “[o]ne thing is clear: the lack of restrictions resulted in many deaths and many more severe or life threatening adverse reactions. Due to FDA’s lax reporting requirements, the exact number is not ascertainable,” the judge wrote.
First approved under the Clinton administration, mifepristone is used to abort unborn babies up to about 10 weeks of pregnancy – although some abortionists use it later. It works by blocking the hormone progesterone and basically starving the unborn baby to death. Typically, abortion groups also prescribe a second drug, misoprostol, to induce labor and expel the baby’s body.
Studies indicate the risks of the abortion drug are more common than what abortion activists often claim, with as many as one in 17 women requiring hospital treatment.
Along with millions of unborn babies’ deaths, the FDA has linked mifepristone to at least 28 women’s deaths and 4,000 serious complications. However, under President Barack Obama, the FDA stopped requiring that non-fatal complications from mifepristone be reported. So the numbers almost certainly are much higher.
A recent study by the Charlotte Lozier Institute found that the rate of abortion-related emergency room visits by women taking the abortion drug increased more than 500 percent between 2002 and 2015.
Another new study from the University of Toronto, “Short-Term Adverse Outcomes After Mifepristone–Misoprostol Versus Procedural Induced Abortion,” published in the Annals of Internal Medicine, found that one in ten women who took the abortion pill had to go to the emergency room, according to Pregnancy Help News.
Since the overturning of Roe v. Wade, the pro-abortion movement has been pushing abortion drugs even more heavily, and some groups send the drugs to women in pro-life states illegally.
Meanwhile, the Biden administration has been trying to expand the life-destroying drugs even further, first by allowing mifepristone to be sold through the mail without any direct medical supervision, and, more recently, by allowing pharmacies like Walgreens, CVS and RiteAid to sell them.
In California, public colleges and universities also now are required to provide abortion drugs for free on campus, and other Democrat-run states are considering similar mandates.
