Texas AG Ken Paxton Sues to Stop Abortion Pills From Out of State

Texas Attorney General Ken Paxton is suing a Delaware-based nurse practitioner for reportedly shipping dangerous abortion-inducing drugs into the state.

This is the latest effort to shield unborn children and women from out-of-state abortion pill sellers skirting Texas’ pro-life laws.

The lawsuit, filed Tuesday in Jefferson County District Court, targets abortionist Debra Lynch, who operates the telemedicine group Her Safe Harbor, along with Delaware Community Care LLC. Paxton alleges Lynch has “knowingly and willfully” violated Texas law by distributing chemical abortion pills to Texas residents, despite the state’s strict ban on abortions except in medical emergencies and only when done by licensed physicians.

In a statement, Paxton said, “The day of reckoning for this radical out-of-state abortion drug trafficker is here.” He added, “No one, regardless of where they live, will be freely allowed to aid in the murder of unborn children in Texas.”

Texas law prohibits the mailing or telemedicine prescription of abortion drugs without proper authorization, aiming to protect mothers from severe health risks associated with unsupervised use. Studies have shown abortion pills can be 22 times more dangerous than reported by federal regulators, with about 1 in 10 women facing life-threatening complications like heavy bleeding, infection or sepsis.

The suit seeks a court order to block Lynch from “performing, inducing or attempting abortions” in Texas. It follows a cease-and-desist letter Paxton sent to Her Safe Harbor in August 2025, after which Lynch reported receiving over 150 requests for abortion pills from Texas.

In media reports cited in the lawsuit, Lynch acknowledged mailing pills to Texans or advising them on obtaining abortions. Responding to the earlier cease-and-desist, she said, “None of our providers are primarily concerned with our own wellbeing or our own legal status.”

Paxton’s action comes amid broader interstate battles over abortion since the U.S. Supreme Court overturned Roe v. Wade in 2022. Texas has pursued similar cases, including a 2024 lawsuit against New York-based abortionist Margaret Carpenter for mailing abortion drugs that led to the death of an unborn child and hospitalized a 20-year-old Texas woman with serious complications.

In that case, Paxton said, “In this case, an out-of-state doctor violated the law and caused serious harm to this patient. This doctor prescribed abortion-inducing drugs—unauthorized, over telemedicine—causing her patient to end up in the hospital with serious complications. In Texas, we treasure the health and lives of mothers and babies.”

Paxton also emphasized his commitment to enforcement: “No matter where they reside, pro-abortion extremists who send drugs designed to kill the unborn into Texas will face the full force of our state’s pro-life laws.”

Delaware, where Lynch is based, has a shield law expanded in late 2025 to protect abortionists from out-of-state investigations, though its application to cross-state telemedicine remains uncertain. Legal expert Mary Ziegler noted of the Texas suit against Lynch, “It doesn’t sound like they know when any of the abortions happened.”

The lawsuit also aligns with Texas’ recent challenge alongside Florida against the FDA’s approval of mifepristone, the primary abortion pill, filed in December 2025. That suit argues the FDA’s deregulation, including allowing telehealth and mailing, has “placed women and girls in harm’s way” by ignoring safety requirements like in-person screenings for risks such as ectopic pregnancies.
