AUSTIN (KXAN) — A conflict at a birthday party in November led to a fatal shooting in east Austin, according to court documents filed in January.
Court documents said 18-year-old Andrew Dominic Aviles was charged with first-degree murder in connection with the shooting death of a 16-year-old. Records showed during the shooting, a 15-year-old was also shot.
Aviles was arrested by the U.S. Marshals-led Lone Star Fugitive Task Force on Jan. 10 in Elgin in connection with the shooting.
KXAN reached out to Aviles’ attorney. This article will be updated if a statement is received.
According to court documents, on Nov. 25, officers with the Austin Police Department responded to calls regarding gunshots in the 2500 block of Sol Wilson Avenue.
At the scene, officers found a 16-year-old in the front yard of a residence with a gunshot wound to the chest. Another teen was also found with a gunshot wound, according to an affidavit.
Documents said police found signs of a disturbance inside the residence, as well as a large amount of bullet casings in the front yard.
According to witness statements, there was a birthday party being held at the residence for the 16-year-old when a group of “unwanted” guests arrived. A verbal altercation ensued, and the group was told to leave, according to the affidavit.
Court documents said the group left, walked toward their vehicles and returned with firearms.
A witness told police the 16-year-old and others left the residence “presumably to confront” the unwanted guests, which was when the witness said they heard gunshots.
Aviles was identified as a suspect in the shooting through personal descriptions from witnesses and family members of the 16-year-old who was killed.
According to court documents, Aviles was booked in the Travis County Jail on charges unrelated to the November incident, and on Dec. 5, he was interviewed by police where he said he was at the party and handled a firearm while there.
As of Wednesday, Aviles remained booked in the Travis County jail on the murder charge and held on a $750,000 bond.
