Concerning the legitimacy of imposing sanctions on the Bank of Russia and individuals in the EU to freeze their assets
Based on the analysis of the articles of COUNCIL REGULATION (EU) No. 269/2014 dated March 17, 2014 and Article 215 of the EC Treaty it can be concluded that the Council does not have the authority to establish restrictions on the ownership and disposal of property of other states on the territory and in financial institutions of the Union and member states. Thus, the freezing of assets of the Russian Central Bank in the national banks of participating countries is illegal and can be challenged the same as the freeze and seizure of private assets of Russian individuals.
